Terms and Conditions for PXM Unlocked

Welcome to PXM Unlocked! These Terms and Conditions (“Terms”) govern your use of our websites, including www.pxmunlocked.com and www.experiences.pxmunlocked.com (the “Sites”). By accessing or using our Sites and booking our services or purchasing products, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Sites or services.
1. Acceptance of Terms
By using our Sites or booking any experiences, services, or products offered by PXM Unlocked or any of its subsidiary names, you confirm that you have read, understood, and agree to comply with these Terms and Conditions, including our Privacy Policy. These Terms apply to all users of the Sites, including guests, customers, and partners.
Additionally, PXM Unlocked accepts bookings via online channels or social media platforms, including but not limited to Instagram, WhatsApp, email, phone, direct bank transfer, cash payments, or in person. If you choose to make a booking or payment through these methods, including payments made outside of the PXM Unlocked booking platform, you acknowledge and agree that you are still fully bound by these Terms and Conditions, and that your booking remains subject to the same policies, cancellation terms, payment conditions, and liability limitations as bookings made directly through our Sites.
These Terms and Conditions are publicly available on our website and it is the responsibility of the guest or client to review and understand them prior to making any booking or payment.
2. Services and Products Provided
PXM Unlocked serves as a booking platform, concierge service, and travel experience provider that connects guests with local vendors, property owners, and service providers offering a variety of services, including but not limited to:
Private Experiences and Tours: Customized private tours, ocean activities, wellness sessions, transport services, adventure experiences, and luxury concierge experiences in Puerto Escondido and surrounding areas.
Travel and Concierge Services: Personalized travel planning, itinerary creation, restaurant reservations, airport transportation, in-villa services, private chefs, wellness services, event staffing, and guest concierge assistance.
Villa and Accommodation Bookings: Villa rentals, luxury stays, Airbnb accommodations, and private property bookings arranged through local property owners and managers.
Private Events and Group Packages: Bachelor and bachelorette experiences, birthdays, celebrations, retreats, corporate events, wellness retreats, romantic experiences, and custom group itineraries including event planning, coordination, rentals, décor, entertainment, and staffing services.
Health and Wellness Products: Including health shots and wellness-related products designed to complement our experiences and services.
Please note: All vendors, property owners, transportation providers, chefs, wellness practitioners, tour operators, event suppliers, and other service providers are independently owned and operated third parties sourced locally by PXM Unlocked. PXM Unlocked does not own, operate, manage, control, or directly provide these services unless expressly stated otherwise. We solely facilitate the booking and coordination process between you and the third-party providers.
PXM Unlocked may also act as a booking platform or intermediary for villa and accommodation reservations offered through our Sites, partner channels, or third-party property owners and managers. PXM Unlocked does not own, operate, manage, or control the villas or accommodation properties listed unless otherwise stated.
All villa and accommodation services are provided solely by independent third-party property owners, managers, or operators. PXM Unlocked is not responsible for the condition of the property, maintenance issues, damages, losses, theft, injuries, accidents, delays, cancellations, service interruptions, or disputes arising in connection with the accommodation or services provided by third-party property owners or managers.
Villa and accommodation bookings may be subject to separate rental agreements, house rules, security deposit requirements, cancellation policies, and payment terms established by the respective property owner or manager. Cancellation and refund policies may differ depending on the property booked. Guests are responsible for reviewing and complying with the specific terms and conditions provided for each individual property booking, which shall apply in addition to these Terms and Conditions.
PXM Unlocked is not responsible for the actions, behavior, negligence, quality, performance, delays, cancellations, accidents, injuries, damages, losses, theft, or disputes arising from services provided by third-party vendors, property owners, managers, or operators. All services, tours, transport, accommodation bookings, concierge services, and events are provided solely by the respective third-party providers, and any issues, complaints, or claims relating to such services should be directed to the applicable provider.
3. Booking and Payment
Booking: To book any service, experience, or product, you must complete the booking process on the PXM Unlocked website. By submitting your booking or purchase, you acknowledge that the information provided is accurate and complete.
Alternative Booking Methods: You can also make bookings via online channels or social media platforms, including Instagram, WhatsApp, email, or in person. If you choose to book through these alternative methods, we will enter your booking details into our booking system. However, all bookings made through these channels are still subject to these Terms and Conditions, and you agree to be bound by them.
Payment Methods: Payment for bookings and products must be made through the available payment methods, which may include:
Credit Cards (Visa, MasterCard, American Express, etc.)
PayPal
Apple Pay
Google Pay
Bank Transfers (Mexico and International)
Cash (in-person payments)
Other online payment methods as specified on the Sites.
All payments are processed securely.
Currency: All payments will be processed in Mexican Pesos (MXN) unless otherwise specified.
Confirmation: Your booking or product purchase will be confirmed upon receipt of full payment and will be subject to availability. PXM Unlocked does not guarantee the provision of services, as it depends on the local vendors.
4. Cancellations and Modifications
Our Commitment:
At PXM Unlocked, we genuinely want every guest to have the best possible experience. If unexpected changes arise, we’ll always do our best to adapt, reschedule, or adjust your booking where possible so you can still enjoy everything Puerto Escondido has to offer. Our goal is to make sure your time here is seamless, memorable, and stress-free.Cancellations:
Cancellations are subject to both seasonal policies, vendor terms, and the type of experience, accommodation, package, or event booked.30 days or more before the experience date:
Full refund (less the 10% payment processing and administration fee).Between 7 and 30 days before the experience date:
50% refund (less the 10% payment processing and administration fee).Within 7 days of the experience date:
Non-refundable, as suppliers, accommodation providers, and service providers will have been paid and logistics organized.High Season Bookings:
For bookings falling within 30 days of the experience date during high season, holidays, or special dates, cancellations and refunds are at the discretion of PXM Unlocked, as vendor, accommodation, and supplier policies may vary.Specific Experiences:
Certain experiences such as Argentinian BBQ, Yacht Rentals, Paella Experiences, private events, custom itineraries, group experiences, villa packages, and other customized services may be subject to separate cancellation and refund policies depending on the nature of the booking, vendor terms, accommodation policies, seasonal demand, staffing requirements, and operational commitments. Any applicable refund terms for these bookings will be communicated on a per-booking basis.Packages, Private Events, and Payment Plans:
For curated travel packages, private events, bachelor and bachelorette experiences, retreats, group bookings, custom itineraries, villa experiences, and bookings arranged under payment plans, the initial 20% deposit or first payment made toward the booking is strictly non-refundable under all circumstances.More than 30 days before the scheduled experience or event date:
Any payments made beyond the initial non-refundable 20% deposit may be refunded, less the 10% payment processing and administration fee, vendor costs, accommodation costs, and any non-recoverable expenses already incurred.Between 14 and 30 days before the scheduled experience or event date:
Refund eligibility will depend on vendor policies, accommodation policies, staffing commitments, operational costs, and non-recoverable expenses already incurred.Within 14 days of the scheduled experience or event date:
Non-refundable, as vendors, staffing, logistics, accommodation bookings, rentals, transportation, entertainment, and event-related services will have been confirmed and paid.Villa and Accommodation Bookings:
Villa and accommodation bookings may be subject to separate cancellation policies, refund terms, security deposit requirements, and rental agreements established by the respective property owner or manager. Guests are responsible for reviewing the specific cancellation and refund terms provided for each individual property booking.Modifications:
Any changes to the date, time, accommodation, guest count, service, event details, or product order must be made in advance and are subject to availability. Additional charges may apply depending on vendor terms, accommodation policies, seasonal rates, and the scope of the requested changes.Refunds:
Refunds will be issued according to this policy and may be subject to cancellation fees, vendor charges, accommodation fees, staffing costs, and non-recoverable expenses. All refunds are processed to the original payment method.Please note that all refunds are less a 10% payment processing and administration fee, which includes payment processor charges, Stripe transaction fees, currency conversion costs, administrative costs, and operational handling fees associated with processing the original payment and refund.
All payments and refunds are securely handled by Stripe, our third-party payment processor. Refund timelines, exchange rates, and any transaction fees are subject to Stripe’s refund policies and may vary depending on your bank, card issuer, or currency.
PXM Unlocked is not responsible for any direct refunds related to services, accommodation bookings, or experiences provided by third-party vendors, property owners, or operators, nor for any exchange rate or currency conversion differences that may occur during the refund process.
5. User Responsibilities
Accurate Information: You agree to provide accurate and complete information during the booking process or product purchase, including payment details. Any changes to your information must be updated promptly.
Compliance: You agree to comply with all local laws, regulations, and guidelines while using our services or purchasing our products.
Behavior: You agree to act in a respectful manner towards staff, other guests, and the local community. We reserve the right to refuse service or cancel bookings if inappropriate or disruptive behavior occurs.
6. Limitation of Liability
PXM Unlocked acts solely as a booking platform and is not responsible for the provision, quality, or performance of any services, tours, transport, or events offered by third-party vendors.
Vendor Liability: We are not responsible for the actions, behavior, or negligence of the third-party vendors. Any issues arising from their services, including but not limited to delays, cancellations, accidents, injuries, damages, or dissatisfaction, are the sole responsibility of the vendor, and all claims related to such services should be directed to them.
Force Majeure: We are not responsible for failure or delay in providing services or products due to events beyond our control, including natural disasters, strikes, government actions, or other unforeseen circumstances.
Travel and Transport: Any transportation services provided are subject to availability and the terms of the third-party vendors. We do not assume liability for delays, accidents, or damages caused by the vendors.
Food Preparation and Liability: PXM Unlocked is not liable for any food poisoning, sickness, or other health-related issues arising from food prepared by third-party vendors, including chefs or catering services arranged through our platform. The liability for food quality, safety, and preparation rests entirely with the vendor providing these services.
7. Intellectual Property
All content on our Sites, including logos, graphics, text, images, videos, and other materials related to the services or products offered by PXM Unlocked or any of its subsidiaries, are owned by PXM Unlocked or licensed to us. You may not reproduce, distribute, or create derivative works from any content without express written permission.
8. Privacy and Data Protection
By using our Sites and booking our services or purchasing our products, you agree to our Privacy Policy, which governs how we collect, store, and use your personal information. We are committed to protecting your privacy in compliance with applicable data protection laws.
9. Third-Party Links and Services
Our Sites may contain links to third-party websites or services that are not owned or controlled by PXM Unlocked. We are not responsible for the content, privacy policies, or practices of third-party websites. We encourage you to review the terms and privacy policies of any third-party sites you visit.
10. Amendments to Terms and Conditions
PXM Unlocked reserves the right to modify, update, or revise these Terms at any time. Changes will be posted on this page with an updated “Effective Date.” By continuing to use the Sites or services after such changes, you agree to be bound by the updated Terms.
11. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Mexico. Any disputes arising out of or in connection with these Terms shall be resolved through negotiation or, if necessary, binding arbitration in Puerto Escondido, Oaxaca, Mexico.
